MarketMapr Terms of Service

Last updated 9 October 2026

1. About these terms

These Terms of Service are a binding agreement between MARKETMAPR LIMITED, a company registered in England and Wales (company number 15426945) ("MarketMapr", "we", "us") and the person or entity using the Services ("you", the "Customer"). By creating an account, accessing or using the Services, you agree to these terms. If you use the Services on behalf of a company or other entity, you confirm you have authority to bind that entity, and "you" means that entity, including every individual user it authorises ("Authorised Users"). You are responsible for your Authorised Users' compliance with these terms.

If you do not agree to these terms, do not use the Services. Where you have a signed order form or master agreement with us, that document prevails over these terms to the extent of any conflict.

2. The Services

MarketMapr is a recruitment-intelligence platform for mapping, searching, enriching and monitoring candidate and company data (the "Services"). The Services include access to a professional and company dataset licensed by MarketMapr from third-party data providers (the "Licensed Data" — defined in section 5), alongside tools for your own uploaded data, enrichment, AI-powered analysis, market monitoring and integrations.

We develop the Services continuously and may add, change or withdraw features. Where a change materially reduces core functionality you have paid for, we will give reasonable notice.

3. Accounts and user responsibilities

You must provide accurate registration information and keep it current. You are responsible for safeguarding account credentials and for all activity under your accounts. Notify us immediately of any unauthorised use. Accounts, logins and credits are for your organisation's use only and may not be shared with, licensed to, sold or transferred to any third party without our prior written consent.

You agree to use the Services only for lawful recruitment, talent-intelligence and business-development purposes, in compliance with applicable law, including data protection law, and not to use the Services to send unlawful communications or to harass, discriminate against or harm any person.

4. Subscriptions, billing and credits

Paid plans run for the subscription period in your plan or order form and renew automatically at our then-current rates unless cancelled before renewal. Fees are payable in advance and, except where required by law or expressly stated, non-refundable. We may change prices on notice, effective from your next renewal.

Credits purchased for enrichment, monitoring, data access or similar features are consumed as used, expire as stated at purchase, have no cash value, and may not be sold or transferred outside your organisation. Usage allowances (including record mapping and export allowances under section 7) are set by your plan tier.

5. Licensed Data — what you may do

"Licensed Data" means the professional profile and company records, and all related fields, made available through the Services from MarketMapr's third-party data providers, together with any updates, enrichments and derivatives of those records delivered through the platform. Licensed Data does not include content you upload (section 9).

Subject to these terms and your plan limits, we grant you a non-exclusive, non-transferable, non-sublicensable licence during your subscription to:

"Internal use" means use by you and your Authorised Users in the conduct of your own business. It does not include making Licensed Data available to any third party as data, whether for payment or free of charge, except an individual record shared in the ordinary course of recruitment work (for example, presenting a candidate profile to your own hiring client).

6. Licensed Data — what you may not do

You must not, and must not permit or assist anyone else to:

These restrictions survive termination of these terms and apply to Licensed Data wherever it is held, including records you have exported.

7. Export caps and enforcement

Access to Licensed Data is subject to volume limits, including per-user and per-operation caps on the number of records that may be imported or exported, set by your plan tier and shown in the platform. We may adjust limits to reflect our obligations to data providers, on notice where the change is material to a paid plan.

We monitor usage volumes and patterns to enforce this section. Attempting to circumvent limits — including by splitting activity across users, accounts, time periods or exports — is a material breach. If we reasonably believe Licensed Data is being extracted, redistributed or used in breach of sections 5–7, we may suspend affected accounts or access to Licensed Data immediately while we investigate, and may terminate for material breach. Where lawful and practicable we will notify you and give you an opportunity to remedy.

8. Data removal, opt-outs and downstream deletion

Licensed Data includes information about individuals who may exercise rights over it. Records may be corrected or removed from the platform at any time, including where an individual objects or requests erasure, where our data providers withdraw a record, or where we are otherwise required to do so. We are not liable for changes to or removal of records.

Where we notify you that specific records you have exported must be deleted (for example following an individual's erasure request), you will delete those records from your systems — including any ATS, CRM or other system into which you loaded them — promptly and in any event within 30 days of notice, and confirm deletion on request. This obligation survives termination.

Nothing in this section limits your own obligations as a controller of personal data you hold (section 12).

9. Your content

You retain ownership of data and content you upload to the Services ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit, display and adapt Your Content solely as needed to provide, secure and improve the Services (including storing it with our hosting providers and processing it through the platform's features at your direction). We do not make Your Content available to other customers and do not use it for any purpose other than providing the Services to you, except in aggregated or de-identified form to improve the Services.

You are responsible for Your Content and confirm you have the rights and lawful basis needed to upload and use it in the Services. We may remove content that we reasonably believe is unlawful or breaches these terms, with notice where practicable.

10. Intellectual property

The Services — including the platform, software, interfaces, documentation and our own content — are owned by MarketMapr and its licensors, and are protected by intellectual property rights. Licensed Data is and remains the property of MarketMapr's data providers and/or MarketMapr; you acquire only the limited usage rights in section 5, and no ownership of Licensed Data passes to you. If you give us feedback or suggestions, we may use them without restriction or compensation.

11. Integrations and third-party services

The Services can connect to third-party products you use — for example your ATS, CRM, email or enrichment providers. Your use of a third-party product is governed by that provider's own terms, and we are not responsible for third-party products. Where you use an integration to send records to your own systems, section 5's internal-use licence and sections 6–8's restrictions continue to apply to those records. You authorise us to exchange data with a third-party product as needed to operate an integration you enable.

12. Privacy and data protection

Each party will comply with applicable data protection law, including UK GDPR and the Data Protection Act 2018, in connection with the Services. Our Privacy Policy explains how we process personal data when we act as controller. Where we process personal data in Your Content on your behalf, we act as processor and our Data Processing Addendum applies.

In respect of Licensed Data records you export or import into your own systems, you are an independent controller and are responsible for your own lawful basis, transparency and handling of data-subject rights in your systems. You will refer data-subject requests relating to the platform to us promptly, and cooperate with us in handling them (including section 8 deletions).

13. Service changes and availability

We aim to keep the Services available and performant, but do not guarantee uninterrupted or error-free operation, and scheduled maintenance, provider outages or events beyond our reasonable control may affect availability. Data refresh frequency depends on our data providers and varies by record. We may impose reasonable technical limits (such as storage, processing or rate limits) to protect the Services.

14. Termination

You may stop using the Services at any time; cancellation takes effect at the end of the current subscription period. Either party may terminate for material breach not remedied within 14 days of written notice; we may suspend or terminate immediately for breach of sections 5–8 as described in section 7, or where required by law or by our data providers.

On termination: your access to the Services and to Licensed Data within the platform ends; your licence to import or export further Licensed Data ends; and records you validly exported before termination may be retained and used solely for your continuing internal use, subject always to sections 6 and 8 (which survive). We will make Your Content available for export for 30 days after termination, after which we may delete it.

Sections 5–8, 9 (licence to Your Content, as needed to wind down), 10, 12, and 15–19 survive termination.

15. Disclaimers

The Services and Licensed Data are provided "as is" and "as available". Licensed Data is compiled from public and third-party sources: we do not warrant that it is accurate, complete, current or suitable for any particular purpose, and you are responsible for verifying information before relying or acting on it — including before making any decision about an individual. To the fullest extent permitted by law we exclude all implied warranties, conditions and terms. Nothing in these terms excludes liability that cannot lawfully be excluded.

16. Limitation of liability

Neither party excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited. Subject to that: neither party is liable for loss of profits, revenue, goodwill, anticipated savings or data, or for indirect or consequential loss; and each party's total aggregate liability arising out of or in connection with these terms in any 12-month period is limited to the fees paid or payable by you for the Services in that period.

17. Indemnity

You will indemnify and hold harmless MarketMapr against losses, damages, costs and expenses (including reasonable legal fees, and amounts payable to our data providers) arising from: (a) your breach of sections 5–8 (Licensed Data use, restrictions, caps and deletion obligations); (b) Your Content; or (c) your use of exported records in your own systems, including any claim by an individual arising from that use. This indemnity does not apply to the extent a claim results from our breach of these terms.

18. Changes to these terms

We may update these terms from time to time, including to reflect changes in the Services, law or our obligations to data providers. For material changes we will give at least 30 days' notice by email or in-platform notice. Continued use after the effective date constitutes acceptance; if you do not agree, you may cancel with effect from the end of your current subscription period.

19. Governing law and general

These terms, and any dispute or claim (including non-contractual) arising out of them, are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction — except that nothing prevents either party seeking injunctive or other urgent relief in any court of competent jurisdiction (in particular in respect of sections 5–8 or intellectual property).

You may not assign these terms without our prior written consent; we may assign them to an affiliate or in connection with a merger, acquisition or sale of assets. Neither party is liable for failure to perform caused by events beyond its reasonable control. If any provision is found unenforceable, the remainder stays in force. These terms, together with your order form, our Privacy Policy and Data Processing Addendum, are the entire agreement between us regarding the Services. Notices to us: alex@marketmapr.com.
